1. Acceptance of These Terms

Welcome to arc-elevate.com, operated by Aviation Resource Consulting LLC (ARC), an Iowa limited liability company specializing in helicopter safety training and aviation consulting for utility, construction, firefighting, night vision goggle, and Department of Defense operations. By accessing or using this website, including any subdomain, free tool, or training program offered through it, you agree to be bound by these Terms of Use. If you do not agree, please do not use the site.

2. Use of the Site

This website exists to provide information about ARC's services, to offer free educational tools, and to deliver training programs. You may not use it for any unlawful purpose, to interfere with its functionality, or to transmit harmful content. ARC reserves the right to restrict or terminate access at its discretion.

3. Free Tools and Educational Resources

ARC offers free interactive tools and downloadable resources, including risk assessments, landing zone assessments, survey guides, personal minimums builders, training audits, and printable checklists (together, the "Free Tools").

The Free Tools are educational planning aids only. They do not replace aircraft performance data, manufacturer limitations, operator procedures, regulatory requirements, company policy, or the judgment of the pilot in command. No score, output, or result produced by any Free Tool constitutes operational approval, a go or no-go decision, or a substitute for a formal risk assessment required by your operator or regulator. You remain solely responsible for every operational decision you make.

Access to certain Free Tools may require providing your name and email address. Use of that information is described in our Privacy Policy.

4. Training Programs and Courses

ARC offers training programs, including ESAT (Elevated Standard Aviation Training) courses such as Low-Level Obstacle Avoidance (LLOA). The following applies to all ARC courses and training programs:

Educational purpose. Courses are educational in nature. Completion of an ARC course does not confer a certificate, rating, or endorsement recognized by the FAA or any other regulatory authority, and does not guarantee employment, insurance qualification, contract award, or any operational outcome.

No substitute for required training. ARC courses supplement, and do not replace, training, checking, or currency requirements imposed by regulation, your operator, or your insurer.

Access. Course access is personal to the enrolled student and may not be shared, resold, or redistributed. ARC may revoke access for violation of these Terms.

Payment and refunds. All sales are final. Because ARC courses are digital products with immediate access to proprietary content upon enrollment, we do not offer refunds. Please review the course description carefully before purchasing. If you experience technical difficulties accessing your course, contact us and we will resolve the access issue. 

5. Intellectual Property

All materials on arc-elevate.com and its subdomains, including text, graphics, logos, designs, course content, standard operating procedures, safety guidelines, assessments, and the Free Tools themselves, are owned by ARC or its licensors and protected by copyright and trade secret laws. You may not copy, distribute, modify, or create derivative works from them without written permission, except for personal, non-commercial use. Printing a checklist or a personal minimums card for your own flight planning is permitted and encouraged; republishing or reselling ARC materials is not.

6. Disclaimer of Warranties and Assumption of Risk

This site, the Free Tools, and all course content are provided "as is" without warranties of any kind, express or implied, including accuracy, completeness, reliability, or fitness for a particular purpose. Helicopter operations, particularly low-level, utility, and other high-risk operations, are inherently dangerous. ARC does not warrant that use of any tool, checklist, or course will prevent accidents, incidents, or losses. You acknowledge that you use all ARC content at your own risk and that final authority and responsibility for any flight rests with the pilot in command and the operator.

7. Independent Contractors

ARC may engage independent contractors to deliver services. These individuals are not ARC employees, and their work is governed by separate agreements. ARC is not responsible for their actions beyond the scope of contracted duties.

8. Limitation of Liability

To the fullest extent permitted by law, ARC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of this site, the Free Tools, any course, or reliance on any content, including damages arising from flight operations conducted after using ARC materials.

9. Governing Law

These Terms are governed by the laws of the State of Iowa, and any disputes shall be resolved in the courts of Webster County, Iowa.

10. Changes to These Terms

ARC may update these Terms at any time by posting the revised version on this site with an updated date. Continued use after such changes constitutes acceptance.
